BY BOOKING WITH POP-UP POP-IN YOU AGREE TO THE FOLLOWING TERMS & CONDITIONS OF SERVICE. PLEASE ENSURE YOU HAVE READ AND UNDERSTAND THEM IN FULL BEFORE PROCCEDING WITH BOOKING AS THIS FORMS OUR CONTRACT.

1 GENERAL

1.1   Pop-up Pop-in will do its utmost to make all guests feel as comfortable as possible whilst taking part in our services and activities. A parent, guardian, or host over the age of 18 must be always present. Pop-up Pop-in is not responsible for the general supervision of children at events.

1.2 The host is responsible for ensuring that they have obtained all the necessary permits and/or permissions for hosting an event, with entertainment, at their chosen venue; including council permits for the use of public land where applicable. 

1.3 Pop-up Pop-in will send an email to the host regarding the booking to confirm a time and date, along with the address, contact details, services booked, and the cost. Please check the details and let us know of any changes ASAP.  

1.4 Private Bookings. It is the responsibility of the host to check all details of the booking including times, location, and number of guests. Pop-up Pop-in will wait for up to 20 minutes if they cannot contact the host on the phone.

1.5 Public Park Bookings. It is the responsibility of the host to arrange a meeting location at an agreed time at an entrance to the park at a set time and direct Pop-up Pop-in to the location where we can set up. Pop-up Pop-in will wait up to 20 minutes if they cannot contact the host on the phone.

1.6 Public and Corporate Bookings. It is the responsibility of the host to arrange a meeting location at an agreed time and give detailed instructions on where to set up.

2. HEALTH AND SAFETY

2.1 Safety and comfort are mandatory. Pop-up Pop-in will not work if conditions pose a hazard to their health or safety – this includes but is not limited to exposure to weather and sudden extreme weather events; hazards such as flying debris, exhaust, fumes, smoke, or other irritants; threatening or rowdy individuals; illegal activity and/or use of illegal substances; verbal abuse; sudden illness or injury to Pop-up Pop-in. Pop-up Pop-in alone will decide on whether they feel their health or safety is at risk and will shut down if they feel there is any risk whatsoever.

2.2 Pop-up Pop-in will provide proof of full Public Liability Insurance and a risk assessment is available on request.

2.3 Pop-up Pop-in requires suitable shelter for all events that will be confirmed at the time of booking along with any extra equipment that needs to be provided by the host for example gazebo, table, and chair. It is the host’s responsibility unless agreed prior in writing that these will be provided and will be ready when Pop-up Pop-in arrives. If these are not available and Pop-up Pop-in must search or set up this may result in less time to provide our services to guests.

3. PARTICIPATION

3.1 All children must have permission from a parent, guardian, or host to participate in any services or activities provided by Pop-up Pop-in. The host is responsible for ensuring this and what is booked is suitable for all guests.

3.2 Pop-up Pop-in services and activities are suitable for those over 3 years old. This is a guide and if your guests are younger, it is the host’s responsibility to let Pop-up Pop-in know in advance to make sure sessions are suitable for attendees.

3.3 All children must be over 3 years old and have permission from a parent, guardian or host to be decorated including Face Painting, Biodegradable Glitter Tattoos, Water and Temporary Ink Tattoos. The host is responsible for ensuring this and making sure it is suitable for guests before booking. Please refer to our Face Paint Disclaimer .

3.4 All children must be over 8 years old and have permission from a parent, guardian or host to be decorated with Biodegradable Festival Glitter and the use of our Eco Glitter Bar. The host is responsible for ensuring this and making sure it is suitable for guests before booking. Please refer to our Glitter Tattoo and Festival Disclaimer.

3.5 All children must be over 5 years old and have permission from a parent, guardian or host to have any permanent attachments in hair and have glitter applied to roots. We do have options that are suitable for children over 3 years old and will provide these on request. The host is responsible for ensuring this is suitable for their guests before booking. Please refer to our Hair Braiding and Colour Disclaimer .

3.6 Pop-up Pop-in must be advised if any of the children have known allergies, or skin conditions that may be relevant to face painting. We can do a patch test of any children. All paints the artist uses are FDA-compliant and hypoallergenic but on rare occasions, an allergic reaction can occur. Please refer to our Face paint Disclaimer.

3.7 Pop-up Pop-in must be advised if any of the children have known allergies, or skin conditions that may be relevant to our activities, especially ones involving Food including our Messy Play and Biscuit Decorating. The host is responsible for ensuring this is suitable for their guests before booking as we might not be able to amend it on the day.

3.8 Due to the risk of infection, anyone who appears to be suffering from a cold sore, runny nose, conjunctivitis, or any other infectious skin complaint, or who has an open sore or irritation will not be decorated. Please refer to our Face Paint Disclaimer.

4. PHOTOGRAPHS

4. You agree that Pop-up Pop-in may display and use photographs taken at your event on any display areas in public or in private; for exhibitions, competitions, advertising, websites, social media networks, and for any other purpose deemed appropriate by Pop-up Pop-in. Please refer to our Photography Policy.

5.COPYRIGHT

  • 5.1 Pop-up Pop-in Logo, Characters including names, media packs, and photographs are Pop-up Pop-in intellectual property. Unless prior written approval of Pop-up Pop-in is obtained, you may not modify or use it in any manner. 

6. PAYMENT FOR SERVICES

6.1 A 50% save-the-date fee must be paid to confirm a booking. Bookings are not confirmed until the receipt of this payment.  Payment is not processed until funds have cleared; please allow 2-3 business days. Pop-up Pop-in may continue to accept bookings for the same date until payment has been made.

6.2 Save the Date fees are not refundable. They may be transferable to another booking time/date subject to availability within the same calendar year.

6.3 Payment is required within 5 business days before your event.

6.4 Co-corporate Clients who would like to pay after the event must send a purchase requisition number to confirm booking along with contact details. Bookings are not confirmed until the receipt of this number. Pop-up Pop-in may continue to accept bookings for the same date until a purchase requisition number has been confirmed.

7. CANCELATION POLICY

7.1   Please notify us as soon as possible if you need to cancel or transfer your booking. Cancellations must be made at least 7 days before your booking to transfer your save-the-date fee.

7.2   Cancellations made within 7 days of your event are required to pay for 50% of the total cost of the event, due to loss of business.

7.3   Cancellations made within 24 hours of the event will not be refunded.

7.4   Cancellations made due to unexpected weather conditions on the day will not be refunded.  Reasonable measures should be taken by the host to provide an alternative location for the entertainment to take place, in the event of environmental factors.

7.5   In the event of Pop-up Pop-in being unable to attend your booking due to illness or circumstances out of our control all possible efforts will be made to find a suitable replacement. If unavoidable a full refund will be provided. 

7.6 If Pop-up Pop-in is asked to work extra hours on the day, this will be invoiced after the event or charged via card payment on the day depending on the host.

7.7 Should the event need to be cancelled or postponed due to circumstances that fall under Force Majeure (ie. global pandemic), this will effectively break the contract. In the first instance, the customer will be offered to change to date to a time when the event can be rescheduled. If it becomes evident that rescheduling is not an option, then the customer will be entitled to request full refund minus any custom work already completed or ordered for the event booked by the host.

THE AGREEMENT

The agreement incorporates the entire understanding between Pop-up Pop-in and the host.

These Terms and Conditions are governed by the laws of England and Wales.

DEFINITIONS. For this agreement

HOST/YOU/YOUR refers to and includes the following but not limited to Parent, Guardian, Party Planner, Event Organiser, School, Organisation, Club.

POP-UP POP-IN refers to all work undertaken by Leanne Wilton under the name Pop-up Pop-in including staff and those hired to provide services on behalf of Pop-up Pop-in.

PHOTOGRAPH includes any kind of still or moving image with or without sound and whether stored/transmitted electronically or as hard copy.
